Attacks on critical infrastructure, whether during armed conflicts or peacetime, are considered one of the serious challenges of contemporary international law. These attacks, which can be carried out physically or cyber-based, have catastrophic consequences for civilians and the national security of countries. The present article, using a descriptive-analytical method and relying on library resources and international documents, examines the legal dimensions of the prohibition of attacking infrastructure in international law and analyzes the legal solutions for filing a lawsuit in international courts by studying the US and Israeli attacks on Iran's critical infrastructure. The research findings show that although there is no single treaty definition of critical infrastructure, a customary definition of the concept can be inferred from the practice of states and the positions of international organizations. The principles of distinction, proportionality, and precaution in international humanitarian law confirm the prohibition of attacks on civilian infrastructure, and even in peacetime, such attacks can be considered violations of the right to life and other fundamental human rights. The International Court of Justice, the International Criminal Court, and arbitral institutions are the most important competent authorities for filing lawsuits. However, challenges such as the issue of attribution of cyberattacks, the difficulty of gathering evidence, state immunity, and jurisdictional limitations have created serious obstacles to effective litigation. The article concludes with recommendations such as resorting to friendly treaties, filing lawsuits based on human rights violations, and strengthening international cooperation to establish a comprehensive legal regime in this area.
