    <Abstract>The expansion of cross-border relations and the increasing possibility of crimes against Iranian nationals outside the territorial territory have made the necessity of rethinking the foundations and limits of the Iranian government’s criminal jurisdiction more evident than ever. In the meantime, Article 8 of the Islamic Penal Code of 1392, by accepting passive personal jurisdiction, attempts to guarantee criminal protection for Iranian nationals who are victims abroad; however, the way this article is regulated and the conditions for its application raise important questions in the field of international criminal law, including whether this mechanism, in its current form, is an effective tool for protecting the rights of Iranian nationals or whether it is, in practice, facing limited effectiveness due to legal, technical, and diplomatic obstacles. The importance of this issue is that, on the one hand, supporting Iranian victims in the transnational space is considered one of the fundamental functions of the state, and on the other hand, the development of criminal jurisdiction over acts committed abroad must remain consistent with the fundamental principles of criminal law, including legality, predictability, and respect for the territorial jurisdiction of states. This research, using a descriptive-analytical method and relying on the study of library resources, legal doctrine, and critical analysis of the capacities of law and judicial practice, seeks to answer the question of what are the most important theoretical and implementation challenges of Article 8 and what reforms can lead to its more efficient implementation. The research findings show that although Article 8 is theoretically a manifestation of the legislator&#039;s protective approach towards Iranian citizens, in its implementation it faces significant obstacles such as ambiguity in the concept of &quot;finding the accused&quot;, difficulty in establishing cross-criminality and the law of the place of the crime, weakness of extradition mechanisms, fragmentation of judicial procedure, and problems in establishing the nationality of the victim in cross-border cybercrimes. Accordingly, the research results show that the effectiveness of this article requires the creation of a unified judicial procedure, limiting the scope of passive personal jurisdiction to more serious crimes, and amending the wording and technical text of the law in accordance with the requirements of international criminal cooperation and developments in cyberspace.</Abstract>
    <OtherAbstract Language="FA">گسترش روابط فرامرزی و افزایش امکان وقوع جرم علیه اتباع ایرانی در خارج از قلمرو سرزمینی، ضرورت بازاندیشی در مبانی و حدود صلاحیت کیفری دولت ایران را بیش از پیش آشکار ساخته است. در این میان، ماده ۸ قانون مجازات اسلامی ۱۳۹۲ با پذیرش صلاحیت شخصی منفعل، می‌کوشد حمایت کیفری از اتباع ایرانی بزه‌دیده در خارج از کشور را تضمین کند؛ اما نحوه تنظیم این ماده و شرایط اعمال آن، پرسش‌های مهمی را در حوزه حقوق جزای بین‌الملل برمی‌انگیزد، از جمله اینکه آیا این سازوکار در شکل کنونی، ابزار مؤثری برای صیانت از حقوق اتباع ایرانی به شمار می‌آید یا آنکه در عمل، به دلیل موانع حقوقی، فنی و دیپلماتیک، با کارآمدی محدود مواجه است. اهمیت این مسئله از آن جهت است که از یک سو، حمایت از بزه‌دیدگان ایرانی در فضای فراملی، از کارکردهای اساسی دولت محسوب می‌شود و از سوی دیگر، توسعه صلاحیت کیفری نسبت به اعمال واقع‌شده در خارج از کشور باید با اصول بنیادین حقوق کیفری، از جمله قانونی بودن، پیش‌بینی‌پذیری و احترام به صلاحیت سرزمینی دولت‌ها سازگار بماند. این پژوهش با روش توصیفی ـ تحلیلی و با تکیه بر مطالعه منابع کتابخانه‌ای، دکترین حقوقی و تحلیل انتقادیِ ظرفیت‌های قانون و رویه قضایی، در پی پاسخ به این پرسش است که مهم‌ترین چالش‌های نظری و اجرایی ماده ۸ چیست و چه اصلاحاتی می‌تواند به کارآمدتر شدن آن بینجامد. یافته‌های پژوهش نشان می‌دهد که هرچند ماده ۸ از حیث نظری، تجلی رویکرد حمایتی قانون‌گذار نسبت به اتباع ایرانی است، اما در مقام اجرا با موانع مهمی مانند ابهام در مفهوم «یافت شدن متهم»، دشواری احراز مجرمیت متقابل و قانون محل وقوع جرم، ضعف سازوکارهای استرداد، تشتت رویه قضایی، و نیز مشکلات احراز تابعیت بزه‌دیده در جرایم سایبری برون‌مرزی روبه‌رو است. بر این اساس، نتیجه تحقیق آن است که کارآمدی این ماده مستلزم ایجاد وحدت رویه قضایی، محدود کردن دامنه اعمال صلاحیت شخصی منفعل به جرایم شدیدتر، و اصلاح عبارتی و فنیِ متن قانون متناسب با اقتضائات همکاری کیفری بین‌المللی و تحولات فضای مجازی است.</OtherAbstract>
