    <ArticleTitle>Comparative Study of the Legal and Judicial System in the Achaemenid, Parthian and Sasanian Periods and the Influence of Religion on Government Laws</ArticleTitle>

    <Abstract>The legal and judicial system of ancient Iran, as one of the main pillars of maintaining social order and political legitimacy, underwent significant changes during the three great dynasties of Achaemenid, Parthian and Sasanian. This research aims to comparative study the structure, principles and function of the legal and judicial system in these three periods and also to explain the influence of religion on government laws. The main question of the research is that despite the commonality of some ancient Iranian foundations, what fundamental differences existed in the foundations, sources, judicial structure and the role of religion in the legal systems of these three dynasties and how did these differences affect political cohesion and social justice? The research method is based on a historical-analytical and comparative approach using primary sources (inscriptions, Pahlavi texts, Greek and Roman reports) and secondary sources (contemporary research up to 2026). The findings show that the Achaemenid legal system, relying on legal pluralism and religious tolerance, was heavily influenced by local traditions and laws of subordinate tribes, and Zoroastrianism played a consultative and moral role, not the main source of legislation. In contrast, the Parthian legal system, with a combination of Hellenistic, Mesopotamian and Iranian traditions, had a decentralized structure based on local customs and practices, in which religion played a marginal role. However, the Sasanian legal system, relying on Zoroastrianism as the official religion, placed law entirely at the service of religion, linking “law” with “revelation” (religion), and making Zoroastrian clergymen (mubadan) the highest judicial authority. The results of the research show that as religion gained more influence in the legal system, laws became less flexible and pluralistic, and legal violence increased, although religious cohesion also served as a substitute for ethno-cultural cohesion. This article, by presenting a comparative model, outlines the evolution of the relationship between religion and law in ancient Iran and examines its consequences for legitimacy and political stability.</Abstract>
    <OtherAbstract Language="FA">نظام حقوقی و قضایی ایران باستان، به  مثابه یکی از ارکان اصلی حفظ نظم اجتماعی و مشروعیت سیاسی، در زمان سه سلسله بزرگ هخامنشی، اشکانی و ساسانی دچار تحولات چشمگیری شد. این پژوهش با هدف بررسی تطبیقی ساختار، اصول و کارکرد نظام حقوقی و قضایی در این سه دوره و نیز تبیین تأثیر دین بر قوانین حکومتی انجام شده است. سوال اصلی پژوهش این است که با وجود اشتراک در برخی بنیان های کهن ایرانی، چه تفاوت های بنیادینی در مبانی، منابع، ساختار دادگستری و نقش مذهب در نظام حقوقی این سه سلسله وجود داشته و این تفاوت ها چگونه بر انسجام سیاسی و عدالت اجتماعی تأثیر گذاشته است؟ روش پژوهش مبتنی بر رویکرد تاریخی  تحلیلی و تطبیقی با استفاده از منابع دست اول (کتیبه ها، متون پهلوی، گزارش های یونانی و رومی) و منابع دست دوم (پژوهش های معاصر تا سال ۲۰۲۶) است. یافته ها نشان می دهد که نظام حقوقی هخامنشی با تکیه بر کثرت گرایی حقوقی و مدارای دینی، به  شدت از سنت های محلی و قوانین اقوام تابع تأثیر پذیرفته بود و دین زرتشتی نقش مشورتی و اخلاقی داشت، نه منبع اصلی قانون گذاری. در مقابل، نظام حقوقی اشکانی با تلفیقی از سنت های هلنیستی، بین النهرینی و ایرانی، ساختاری غیرمتمرکز و مبتنی بر عرف و رویه های محلی داشت که دین در آن نقشی حاشیه ای ایفا می کرد. اما نظام حقوقی ساسانی با اتکا به آیین زرتشتی به  عنوان دین رسمی، حقوق را به  طور کامل در خدمت دین قرار داد و «داد» را با «وهی دین» (دین بهی) پیوند زد و روحانیون زرتشتی (موبدان) را به عالی ترین مقام قضایی تبدیل کرد. نتایج پژوهش نشان می دهد که هرچه دین در نظام حقوقی نفوذ بیشتری یافت، قوانین از انعطاف  پذیری و کثرت گرایی فاصله گرفت و خشونت قانونی افزایش یافت، هر چند انسجام دینی نیز به  عنوان جایگزین انسجام قومی  فرهنگی عمل کرد. این مقاله با ارائه مدلی تطبیقی، سیر تحول رابطه دین و حقوق در ایران باستان را ترسیم کرده و پیامدهای آن را برای مشروعیت و پایداری سیاسی بررسی می نماید.</OtherAbstract>
